Can I dispute my insurance adjuster's estimate of value of a totaled vehicle?

I have a vehicle which was totaled. Insurer is Progressive. I live in WA, so the adjuster is not allowed to use NADA or KBB to determine value. He's supposed to provide fair market value. He got two estimates, both of which seem very low to me--less than half the replacement cost of a vehicle from the same year in the same condition. I've asked whether I can submit Craigslist listings from my half of the US to prove the value is higher. He says any documentation must be from within 150 miles of my home, which puts me at a disadvantage since I live in a rural area. Had accident which was my fault in Nov 08, hit a van in rear that stopped suddenly going through a roundabout (less than 5mph) and his trailer hitch ball went into my radiator and damaged the hood, grill and radiator. Car was 1996 Honda in very reasonable condition, MOT'd and all in good service despite its 125,000 mileage, new tyres, exhaust, battery, and clean throughout. Had fully comprehensive insurance with 50 deductable, loaner car and legal support so paid to be protected. When car was collected from accident, collecting garage said at that time that due to the mileage my car would not be repaired. However it took 5 to 6 weeks for the insurance examiner to determine that my car was beyond repair, so I did without a car all that time. Despite repeated phone calls to them, they never called me back as their examiner was on holiday. Then when we finally agree that a price of 500 for my car in January 08 and that took some haggling, the cheque never and so I started chasing them down in early February. I am then informed that I did not disclose a speeding violation on my application and they would have to listen to the tapes of my applying to verify this. Again this took several weeks, and I again had to pursue them for an answer to which they then said I had applied on the internet so no record of a phone conversation. The internet application was misleading, asking for what I believed was 3 years worth of offenses. I've only ever had 2 speeding offenses in my entire life - both speed cameras, just over the limit. The first was at 6 a.m. and I passed a bus pulling over to stop and as I passed it got flashed. The second on the day I found my dad had days to live and I was rushing to catch a flight, and as in both instances was doing 42 mph in a 30 mph zone for a very short period. Nonetheless, I was speeding and paid my fines. I wrote to the insurance company and apologised for not telling them of the other speeding ticket from 4 years and 9 months earlier as I forgot about it. But I admitted it, and apologised in writing. Then then came back to me saying that there would be additional premium to pay before I would get paid for my car. Well, its October 08, and I finally got a letter from the insurers saying they are not paying me as I failed to pay the additional premium requested and they were not going to renew my policy. I have never been asked even after repeated letters to them how much the additional premium was, and what I should do. No replies. I have asked for my car back which they agreed to pay for, and now they state there is nothing they can do, and it is their final decision. I went to the financial ombudsman and unbelieveably DID NOT get a reply from them. I've even spoken to one of their survey staff who tells me that they are incredibly busy and it was probably put aside and not dealt with. I'm at a total loss as to where I stand and how to pursue this without spending more than the accident and car was worth. I've written to their data protection officer and obtained copies of all documentation pertaining to this, so by their records can verify all this information quite clearly. Finally, I maintained my cool with them at all times. Never once did I raise my voice or become unprofessional with them. My questions are: 1. Can I legally request my car back as it has never been paid for? 2. Were they taking money for policy on a car they knew that through mileage alone, they would never pay for loaner car, or to have repaired? 3. This has meant over 30 letters and more phone calls than that to deal with, and rarely do they call you back or reply at all. Can I claim for this time and distress? 4. Am I totally wasting my time? how does that work when I go to the doctor? I just asked the same question, but I worded it all wrong, I think. So, I go to the doctor with strep throat and my co-pay is $50 and I have a $10000 deductable. How much will I actually pay? Logic tells me that with a deductable, like car insurance, I would pay for the entire office visit cost, since it would obviously be less than $10000. And a $25 co-pay for prescriptions! Effective 01/01/11, your monthly dues/premium will automatically be debited from your account on the first of each month.Your first debit will be in the amount of $142.09 to cover the period from 12/12/10 to 02/01/11. After this initial debit, regular withdrawals of $87.00 will be made on the first of each month. Ok, so I understand I am supposed to pay $87 each month. hello thank you for entering in my post I've been in England for 2 years now but I've never driven here however I had driven for 11 years in my country but on the opposite side of the road and with a car with left-hand drive and I've never had an accident before to choose which car to buy I'd like to know roughly how much they would charge me for a 1.2 engine because if they will charge me too much I could opt for 1.0 engine or even smaller for my first 2 or 3 years and then when my isurance cost goes down I will get a bigger car I've alredy have a UK driving licence however, if I do a driving course with a driving school could I get a little discount for my insurance? any suggestion according this matter will be very appreciated thank you very much in advance for your help

I was in a fender bender in a long line of traffic. The front car decided to not use a turn signal and lock up his brakes, causing a chain reaction of everyone having to lock up their brakes. I locked mine up, and my car skidded into the person in front of me. We will car it Car B. Well, Car B was very close to the car in front of him already and Car B hit Car A. The driver of Car B said that there was little to no damage on the rear or front of his car, so he didnt see any means to get the police or insurance involved. Car A has a few tiny marks due to the screws of Car B's front lisence plate. He says that he wants to show it to his parents this weekend, and will let me know Monday. But he has my insurance information. I'm assuming that I would be responsible for his car also. But i'm just wondering how long does he have to turn this in on insurance? I'm afraid that if something else was to happen to his car, him having my information, he could turn it in on something completely unrelated later on.

I own a small business with only two employees. About 2.5 years ago some kids used nylons and a hamburger wrapper in my gas tank to set my truck on fire. It was a brand new tahoe with dealer plates and it had to be deemed totaled due to damages. Why is Geico Home Owner's Insurance So Much More Expensive Than other Companies?

I have had my home owner's insurance through Liberty Mutual and I pay $865.00 per year for about 110,000 in dwelling coverage plus other coverages as well. However, I just decided as I wasn't doing anything today to check on the competition and I called up Geico. Get this.. Here it is... Geico, for the EXACT SAME COVERAGE I am paying Liberty Mutual $865.00 per year gave me a quote for $4,200.00 per year. WITH ALL COVERAGES BEING EQUAL. I was shocked... The lady told me because I had one claim for roof damage which cost $4,000.00 that justified the increase in coverage. Plus Geico had a higher deductible of $1,500.00. First I don't know anyone paying $4,000.00 for a one year home owner's policy for $110,000.00 in coverage. But does anyone know why Geico is so ridiculously expensive?

I took out an insurance policy with swinton Insurance they quoted me 250.00 I agreed to this amount. I have been driving for over 12 years with no claim made against my policy. Due to the way my previous insurer only counted 5 years no claims bonus insurance that is all they have a record plus three years I was with them. Because the new insurer uses 9 years no claims they now want me to pay an extra 22.00 I know on the one hand this is not a lot of money on the other hand I don't see why I should have to pay it. They are saying If I don't pay it they will cancel it and charge a cancellation charge does anyone know the legal situation whether I have to pay by law or not.

Due to an illness/ disability in our family, despite having health insurance, we still owe thousands in medical bills. Those that would not work with us turned them into collection. They now show on our credit report. Despite being insured for both our auto insurance and our home insurance for 20+ year with the same insurance company, we got a notice saying our auto insurance had gone up hundreds of dollars per year based on a credit report they obtained. We have never had an accident, ticket, etc. and the amount automatically comes out of our checking each month. Plus, last year, prior to this, they switched us to a preferred group within the company and gave us a discount when we threatened to switch. How can I find out which insurance companies base your insurance rates on your credit report and or score? Will they tell you outright? This is the first I have ever known that our company did this and was wondering if all of them do it, or do you just know about it when you get a notice like we did? I get their reasoning but it seems like such a rip off when so many are in our boat- insured but with insurance that is starting to pay less and less and cost more.
